Minister Gogu: Council of Europe Recommendations to Guide Review of the Criminal Procedure Code

The Council of Europe’s recommendations on pretrial detention are being incorporated into the ongoing review of Albania’s Criminal Procedure Code. This review examines the rules and safeguards related to security measures.
At a roundtable discussion on security measures, Minister of Justice Toni Gogu said that the Supreme Court’s unifying decision and the case law of the European Court of Human Rights are guiding the work, which focuses on strengthening protections for personal liberty and creating conditions for alternatives to imprisonment to be functional and applicable in practice.
The minister also emphasized the need to maintain the effectiveness of criminal investigations and the guarantees of due process.
Alongside the review of the legal framework, the Ministry of Justice is working to reinstate electronic monitoring and bolster the Probation Service to improve the implementation of alternative measures.
