Minister Gogu Says Amendments to Criminal Procedure Code to Open for Public Discussion on 30 September
On September 30, the Minister of Justice, Toni Gogu, announced that the broadest package of amendments to the Criminal Procedure Code since its adoption will be published in cooperation with the Council of Europe. These amendments will be discussed at a roundtable with heads of justice institutions, as well as representatives from the courts, the prosecution, the legal profession, civil society, the media, and international partners.
The amendments cover security measures, the rights of parties during investigations and trials, evidence and its administration, preliminary hearings, the presumption of innocence, public access to hearings, and the protection of personal data.
The amendments are based on a Council of Europe study of pretrial detention in Albania and established case law developed in recent years by the Supreme Court and Constitutional Court.
Following a decade of reforms in the justice system, the process aims to incorporate the standards and safeguards established through case law into the procedural framework.
According to Minister Gogu, the review aims to ensure that the strengthening of the rule of law is accompanied by stronger procedural safeguards for individuals.
